Request for Expression of Interest (EOI) and Invitation for Pre-Qualification of Contractors for Projects under the FY 2014 Appropriation of the Authority
1.0 Introduction
1.1 The Lower Niger River Basin Development Authority, one of the Parastatals under the Federal Ministry of Water Resources (FMWR), is desirous of executing a number of approved projects under the FY 2014 Appropriation. To achieve this, the Authority hereby request Expression of Interest (EOI) for Consultancy Services and invites pre-qualification documents from interested qualified and competent Companies/Firms and Consultants, Including joint Ventures (JVs) to participate accordingly.
1.2 The Projects earmarked for execution are categorized in the following Lots:
- Consultancy Services:
A1 – Study and Design of flood and Erosion Control Measures
A2- Study and Design of Water Supply Project
- Construction Works:
B1 – Irrigation Construction Works
B2- Water Supply Works (Surface)
B3- Flood and Erosion Control Works/ Dam Rehabilitation
B4- Rehabilitation of Buildings
B5- Rehabilitation of Infrastructure
B6- Water Supply Works (Boreholes)
B7- Mechanical & Electrical (M & E) Works including Renewable Energy Installation
- GOODS
C1 -Supply Works
2.0 Eligibility Criteria
Interested Bidders for any of the above projects are requested to provide the following minimum pre-qualification requirements, arranged serially as itemized for each category of criteria below:
2.1 For Consultancy Services:
a) Certificate of Registration with CAC
b) Tax Clearance Certificate for the last three (3) years (2011, 2012, 2013) with Tax Identification Number (TIN)
c) Evidence of Pension Commission (PENCOM) Compliance Clearance Certificate
d) Evidence of industrial Training Fund (ITT) Compliance Certificate
e) VAT Registration and Remittance for the last three (3) years (2011, 2012 & 2013)
f) Evidence of experience in at least three (3) jobs of similar nature and complexity, previously executed or currently being executed, with verifiable letters of contract award and certificates of job completion (where applicable).
g) Detailed Finn’s profile with copy of Article of Association/memorandum of understanding (if joint Ventures) and Firms Registration with relevant Professional bodies- COREN, COMEG, ARCON, etc
h) Evidence of Financial capability/ Bank reference letter.
i) Submission of three (3) years (2011, 2012 and 2013) Audited Accounts.
j) Possession of satisfactory Quality Assurance/Quality Control Manual as appropriate
2.2 For Works
a) Certificate of Registration with CAC
b) Tax Clearance Certificate for the last three (3) years (2011, 2012 & 2013) with Thx Identification Number (TIN)
c) Evidence of Pension Commission (PENCOM) Compliance Clearance Certificate
d) Evidence of Industrial Training Fund (TTF) Compliance Certificate.
e) VAT Registration and Remittance for the last three (3) years (2011, 2012 & 2013)
f) Evidence of ownership of or access to lease of relevant construction equipment and their status (where applicable)
g) Detailed Company profile with copy of Article of Association/ Memorandum of Understanding (If Joint Ventures).
h) Evidence of Financial capability/ Bank reference letter.
i) Annual Audited Report which shows the financial status of the company in the last three (3) yean (2011, 20l2 and 20l3) Audited Accounts.
j) Possession of satisfactory Quality Assurance/Quality Control Manual as appropriate
2.3 For Goods
a) Certificate of Registration with CAC
b) Tax Clearance Certificate for the last three (3) years (2011, 2012 &2013) with Tax Identification Number (TIN)
c) VAT Registration and Remittance for the last three (3) years (2011, 2012 & 2013 Evidence of Pension Commission (PENCOM) Compliance Clearance Certificate
d) Evidence of Industrial Training Fund (ITF) Compliance Certificate.
e) Evidence of experience in at least three (3) supply jobs, executed within the last five years, with verifiable letters of contract award and certificates of job completion
f) Detailed Company profile with copy of Article of Association/ Memorandum of Understanding (If Joint Ventures).
g) Evidence of Financial capability/Bank reference letter.
h) Annual Audited Report which shows the financial status of the company in the last three (3) years. (2011, 2012 and 2013) Audited Accounts.
i) Possession of satisfactory Quality Assurance/Quality Control Manual as appropriate 2.4 Bidders are requested to also provide sworn Affidavit certifying as follows:
a) that the company is not in receivership, not insolvent or bankrupt,
b) that the company does not have any Director who has been convicted in any Court in Nigeria or any other country for Criminal Offence in relation to fraud or financial impropriety,
3.0 Collection of Pre-Qualification/Expression of Interest Documents
3.1 Interested companies/Firms, on presentation of evidence of payment (Teller) of the prescribed non-refundable processing Fee of N20,000.00 per lot into the Authority’s account as follows:

3.2 All terms and conditions in the collected Documents MUST be strictly adhered to please.
4.0 Submission of Documents
4.1 Submission of completed Request for Expression of Interest (EOI) and Pre-qualification Documents for the Projects of interest should be submitted in Two (2) sets hard copies and One (1) Electronic copy in Microsoft Office and enclosed in a sealed envelope, labeled “Expression Of Interest (EOI) or Pre-Qualification” with “Project Name and Lot Number” on top right-hand corner, addressed and returned to;

4.2 All pre-qualification documents MUST be accompanied with duly signed submission letter by the bidders. Any unsigned document will be disqualified.
4.3 All bidding documents submitted may be subjected to Due Diligence (registration with CAC ,tax clearance certificates, etc) checks in accordance with the Public Procurement Act (PPA)2007.
5.0 The Closing Date for the Submission of bids
5.1 The closing date for the submission of Bid/Expression of interest document shall be on or before 12 noon Monday the 30th June, 2014.
6.0 Opening of Bids
6.1 Bids shall be opened immediately after the deadline for the submission of bids at the car park by 12 noon Monday 30th June, 2014 at the Authority’s Headquarters.
6.2 Only the successful Bidders at the Pre-qualification Stage will be invited for Financial Tendering at a date to be announced.
6.3 All Bidders are expected to bring along the ORIGINAL COPIES of their Certificates of Incorporation and Tax Clearance, for sighting, if required.
6.4 Contractors or their representatives, relevant Non-Governmental Organizations (NGOs) and interested members of die public are hereby invited to witness the Bid Opening.

7.0 Additional Information
7.1 This Invitation is published for information purposes only and does not constitute an offer by this Authority to transact with any party for any of the projects; nor does it constitute a commitment or obligation on the part of this Authority.
7.2 This Authority will not be responsible for any costs or expenses incurred by any interested party in connection with any response to this invitation and/ or the preparation or submission in response to any enquiry.
7.3 The Authority is NOT bound to shortlist any bidder and reserves the right to annul the selection process at any liabilities and assigning any reason thereof.
7.4 The final Conclusion of the procurement process for all projects listed above is subject to adequate budgetary provision in the 2014 Appropriation.
