Request for Expression of Interest (EOI) and Invitation for Prequalification of Contractors for Projects under the FY 2014 Appropriation
1.0 Introduction:
1.1 Ogun-Oshun River Basin Development Authority (O-ORBDA), one of the parastatals under the Federal Ministry of Water Resources (FMWR), is desirous of executing a number of approved projects under the FY 2014 appropriation. To achieve this, the Authority hereby request Expression of Interest (EOI) for Consultancy Services and invites Pre-qualification documents from interested qualified and competent Companies/Firms and Consultants, including Joint Ventures (JVs) to participate accordingly.
1.2 The projects earmarked for execution are categorized in the following Lots:
A. CONSULTANCY SERVICES:
A1 Design Review of Dam’s Spillway
A2 – Study and Design of Irrigation Schemes
A3 – Study and Design of Flood and Erosion Control Measures.
A4 – Study and Design of Water Supply Projects
B. CONSTRUCTION WORKS:
B1 – Irrigation Construction Works
B2- Water Supply Works (Surface) .
B3 – Flood and Erosion Control Works
B4- Rehabilitation of Buildings
B5 – Rehabilitation of Roads
B6- Water Supply Works (Hydrology)
B7 – Mechanical & Electrical (M&E) Works including Renewable Energy Installation
C. GOODS:
C1- Supply Works
2.0 Eligibility Criteria:
Interested bidders for any of the above projects are requested to provide the following minimum pre-qualification requirements, arranged serially as itemized for eachcategory of criteria below
2.1 For Consultancy Services:
I. Certificate of Registration with CAC
II. Tax clearance certificates for the last three (3) years (2011, 2012 & 2013)
- Evidence of Pension Commission (PENCOM) compliance Clearance Certificate
- Evidence of Industrial Training Fund (ITF) compliance Certificate
V. VAT Registration and Remittance for the last three (3) years (2011, 2012 & 2013)
- Evidence of experience in at least three (3) jobs of similar nature and complexity, Previously executed or currently being executed, with verifiable letters of contract award and certificates of job completion (where applicable)
- Detailed Firm’s Profile with copy of Article of Association/Memorandum of Understanding (if Joint Ventures) and Firm’s Registration with relevant professional bodies – COREN, COMEG, ARCON, etc.
- Evidence of personnel capability including list of key professionals, curriculum vitae of each professional and registration with professional bodies such as COREN, COMEG, ARCON, etc.
- Evidence of financial capability/Bank reference letter
X. Submission of three (3) years (2011, 2012 & 2013) Audited Accounts
- Possession of satisfactory Quality Assurance/Quality Control Manual as appropriate
2.2 For Works:
I. Certificate of Registration with CAC
II. Tax clearance certificates for the last three (3) years (2011, 2012 & 2013)
- Evidence of Pension Commission (PENCOM) compliance Clearance Certificate
- Evidence of Industrial Training Fund (ITF) compliance Certificate
V. VAT Registration and Remittance for the last three (3) years (2011,2012 & 2013)
- Evidence of ownership of or access to lease of relevant construction equipment and their status (where applicable)
- Evidence of experience in at least three (3) jobs of similar nature and complexity, previously executed or currently being executed, with verifiable letters of contract award and certificates of job completion (where applicable)
- Detailed Company Profile which should include list of personnel, their qualifications (CV) and experience in similar works
- For Joint Ventures, include Memorandum of Understanding (MoU)
X. Evidence of financial capability/Bank reference letter
- Annual Auditors Report which shows the financial status of the company in the last three (3) years (2011, 2012 & 2013)
- Possession of satisfactory Quality Assurance/Quality Control Manual as appropriate
2.3 For Goods:
I. Certificate of Registration with Corporate Affairs Commission (CAC)
II. Tax clearance certificates for the last three (3) years (2011, 2012 & 2013)
- VAT Registration and Remittance for the last three (3) years (2011, 2012 & 2013)
- Evidence of Pension Commission (PENCOM) compliance Clearance Certificate
V. Evidence of Industrial Training Fund (ITF) compliance Certificate
- Evidence of experience in at least three (3) supply jobs, executed within the last five, years, with verifiable letters of contract award and certificates of job completion
- Detailed Company profile with copy of Article of Association/Memorandum of Understanding (if Joint Ventures)
- Evidence of financial capability/Bank reference letter
- Annual Auditors Report which shows the financial status of the company in the last three (3) years (2011, 2012 & 2013)
X. Possession of satisfactory Quality Assurance/Quality Control Manual as appropriate
2.4 Bidders are requested to also provide Sworn Affidavit certifying as follows:
I. that the company is not in receivership, not insolvent or bankrupt,
II. that the company does not have any Director who has been convicted in any Court in Nigeria or any other country for Criminal Offence in relation to fraud or financial impropriety,
- that no Officer of the Authority is a former or present Director or Shareholder of the company,
- that there has been no promise of a gift in any form to any of the Authority or Bureau of Public Procurement (BPP) staff.
3.0 Collection of Request of Expression of Interest (EOI) and Pre-Qualification Documents:
3.1 Interested Companies/Firms, on presentation of evidence of payment of the prescribed non-refundable processing fee of N20.000.00 per Lot into the Authority’s Account Number: 5030050507 with FIDELITY BANK PLC. IBARA, ABEOKUTA. shall collect Expression of Interest(EOI) and Pre-qualification documents as from 12.00 noon on Monday, 2nd June, 2014 for Lot B6 and Tuesday, 3rd June, 2014 for other Lots at the:
Procurement Unit, (Rooms 32 & 33),
Ogun-Oshun River Basin Development Authority Headquarters,
Alabata Road, Abeokuta, Ogun State.
3.2 All terms and conditions in the collected Documents MUST be strictly adhered to please.
4.0 Submission of Completed Documents:
4.1 Submission of completed Request for Expression of Interest (EOI) and Pre-qualification Document for the Projects of interest should be submitted in four (4) hard copies (one original and three other copies) and one (1) electronic copy in Microsoft Office and enclosed in a sealed envelope, labeled “EXPRESSION OF INTEREST (EOI) or PRE-QUALIFICATION” with “Project Name and Lot Number” on top right-hand comer, addressed and returned to;

4.2 All pre-qualification documents MUST be accompanied with duly signed submission letter by the bidders. Any unsigned document will be disqualified.
4.3 All bidding documents submitted may be subjected to Due Diligence (registration with CAC, tax Clearance certificates, etc) checks in accordance with the Public Procurement Act (PPA) 2007.
5.0 Closing Dates for Submission of Bids:
(i) The closing date for submissions for Lot B6 is Monday, 23rd June, 2014 at 12.00noon prompt. Any bid submitted after this date and time will be rejected.
(ii) The closing date for submission for Lots Al, A2, A3, A4, B1, B2, B3, B4, B5, B7 and C1 is Tuesday, 24th June, 2014 at 12.00 noon prompt. Any bid submitted after this date and time will be rejected.
6.0 Opening of Bids:
6..1 The Bids Opening exercise shall be conducted publicly in the Training School Auditorium of Ogun-Oshun River Basin Development Authority, Abeokuta on the closing dates of submission.
(i) Lot B6 will be opened on Monday, 23rd June, 2014, beginning from 1.00pm.
(ii) Lots Al, A2, A3, A4, B1, B2, B3, B4, B5, B7, and C1 will be opened on Tuesday, 24th June, 2014, beginning from 1,00pm.
6.2 Only the successful Bidders at the Pre-qualification Stage will be invited for Financial Tendering at a date to be announced.
6.3 All Bidders are expected to bring along the ORIGINAL COPIES of their Certificates of Incorporation and Tax Clearance, for sighting, if required.
6.4. Contractors or their representatives, relevant Non-Governmental Organizations (NGOs) and interested members of the public are hereby invited to witness the Bids Opening.

7.0 Additional Information:
7.1 This invitation is published for information purposes only and does not constitute an offer by this Authority to transact with any party for any of the projects; nor does it constitute a commitment or obligation on the part of this Authority.
7.2 This Authority will not be responsible for any costs or expenses incurred by any interested party in connection with any response to this invitation and/or the preparation or submission in response to an enquiry.
7.3 The Authority is NOT bound to shortlist any bidder and reserves the right to annul the selection process at any time without incurring any liabilities and assigning any reason thereof.
7.4 The final conclusion of the procurement process for all projects listed above is subject to adequate budgetary provision in the 2014 Appropriation.
