A. TERMS OF REFERENCE
Mercy Corps (MC) is a non-profit, non-aligned, secular non-governmental (NGO) humanitarian relief and development organization, registered in the United States and Scotland with offices in more than 40 countries around the world, including Nigeria, where the organization has recently started a Conflict & Natural Resource Management Program implemented in Nigeria. Mercy Corps Nigeria has staff based in Abuja. Mercy Corps’ SOAR (Strengthening Opportunities and Access to Resilience) program provides non-food items and livelihood restoration to internally displaced persons (IDPs) and host communities affected by the conflict in northern Nigeria.
Mercy Corps is soliciting bids from qualified Nigerian Companies/Vendors to supply the items as detailed in the attached Annex 1.
B. GENERAL CONDITIONS FOR PROPOSAL
1. Scope: Mercy Corps invites proposals for the supply of items described and summarized in the attached Annex 1. Mercy Corps reserves the right to vary the quantity of items specified in the expression of interest document without any changes in unit price or other terms and conditions and to accept or reject any, all, or part of submitted offers.
2. Language: As determined by Mercy Corps, the working language of this tender is English. Other languages will not be accepted.
3. Source of Financing: The program and project are financed by USAID in Abuja, Nigeria. The Investor has considered Mercy Corps for contracting purposes.
4. Qualifying and Conditions: The main criteria for the acceptance of the proposals are as follows:
a.Registered as a company in Nigeria.
b.Adequate stock of items in warehouse/store.
c.Sufficient trained managers and workers.
d.Good track record and references from previous clients.
e.Recognized bank account (Mercy Corps will make all payments in bank checks or through bank transfers).
Proof of the above must be provided.
- All Proposal Documents must be completed in full, or the application will be disqualified.
- Proposals must be submitted in sealed envelopes no later than 25th August at No 5 Peka close, off Buchanan crescent, off Aminu Kano crescent, Wuse II, Abuja.
- All Applicants will receive identical documents. No applicant should add, omit, or change any item, term or condition on original papers.
- If Applicants have any additional request and conditions, this shall be stipulated in a separate letter accompanying the proposal.
- Each proposal shall be valid for the period of 30 days from its date of submission.
- Proposals shall be made in writing calculated in Naira only end clearly stated on the appropriate forms.
5. Payments: Payments will be made in Naira on the basis of a Goods Received Note filled upon reception of ordered goods.
6. Eligibility of Applicants: Vendors cannot apply if they:
- Are not registered companies.
- Are bankrupt or are in the process of going bankrupt.
- Have been convicted for an offense concerning professional conduct.
- Have been guilty of grave professional misconduct (proven by any means which the contracting authorities can justify).
- Have not fulfilled obligations related to payment of social security and taxes.
- Are guilty of serious misinterpretation in supplying information.
- Are in situations of conflict of interest (with prior relationship to project or family or business relationship to parties on the Mercy Corps Committee).
- Were declared at serious fault of implementation owing to a breach of their contractual obligations
- Are on any international list of sanctioned parties.
Vendors can apply if:
- They are legally registered to operate and provide such work in Abuja, Nigeria. (Submission of copies of registration is mandatory – copies of CAC certificate and Memorandum and article of association).
- They have experience in supplying products for more than three (3) years.
