Disposal Through Public Tender
(1.0) Introduction
(1.1) The Federal Ministry of Transport wishes to advertise for the Sale of its landed property situated at No. 3 Milverton Road, Ikoyi, Lagos.
(1.2) Following the Judgment of the Federal High Court in Suit No
FHC/L/CS/1422/2009; Safety Wheels Limited Vs Minister of Transport & 3 others, the earlier sales to Safety Wheels Limited and subsequently to SIMEC Chemical Engineering Construction Company Ltd were nullified. The Court directed that the property be re-advertised and Right of First Refusal given to the sitting tenant.
(1.3) In compliance with the Judgment of the Court, the Federal Ministry of Transport hereby invites interested bidders to tender for the purchase of the landed property situated at No. 3 Milverton Road, Ikoyi, Lagos.
(2.0) Mandatory Requirements without which a Bidder shall be disqualified:
(2.1) Evidence of Current Tax Clearance Certificate for the last three years (2012, 2013 and 2014) by inclusion of photocopy
(2.2) Evidence of registration with Corporate Affairs Commission (CAC) by inclusion of Certificate of Incorporation for corporate bodies.
(2.3) Evidence of VAT Registration for corporate bodies.
(2.4) Evidence of compliance with Pensions Reform Act, 2004 by inclusion of Certificate of Compliance from the National Pensions Commission (where applicable).
(2.5) Evidence of Compliance with the Industrial Training Fund Amendment Act, 2011 by inclusion of Certificate of Compliance from the Industrial Training Fund (where applicable).
(2.6) Evidence of compliance with contribution to the Nigeria Social Insurance Trust Fund (where applicable).
(3.0) Payment Terms and Conditions:
(3.1) The property will be sold on “as is, where is” basis at the evaluated price with the current occupants having the right of refusal within thirty days of offer. The said right to purchase is neither transferable, assignable nor alienable in any way or form.
(3.2) Strict compliance with development control standards of all relevant Authorities must be adhered to by the purchaser.
(3.3) The winner shall be the highest bidder over and above the Ministry’s reserved price. In a situation where no bidder meets the reserved price, the three (3) highest bidders will be invited to re-bid for the building.
(3.4) A deposit equal to ten percent of bid value by way of bank draft, drawn in favour of Federal Ministry of Transport shall accompany the FREE application form.
(3.5) A Simple Auction System by way of competitive bidding shall be employed. All bids without a deposit stand disqualified. The highest bidder shall be automatically declared the winner, along with the second highest bidder as the reserved bidder.
(3.6) The highest bid price will then be offered to the occupier to exercise the Right of First Refusal by effecting ten percent non-refundable deposit within fourteen days. If the occupier fails to exercise the right of first refusal, the preferred bidder will be allowed to complete the transaction as envisaged.
(3.7) The Banker’s Cheque of the next two highest bidders (being the reserved winners) shall not be returned until the bidding process is completed and full payment is made by the winner.
(3.8) If the reserved price is not met, the disposal will go for a further round of bids.
(3.9) Twenty five percent (25%) of purchase price (including the deposit of ten percent (10%) must be paid to Federal Ministry of Transport within thirty (30) days of the Offer Letter.
(3.10) Balance of seventy five percent (75%) must be paid by the purchaser within an additional sixty (60) days; thus, the purchaser must effect full payment within ninety (90) days of contract.
(3.11) All transaction charges shall be for the account of the purchaser.
(3.12) In the event the purchaser fails to comply with the payment terms, the deposit (being 10% of the purchase price) will be forfeited to the Federal Government, the contract of sale shall be rendered null and void, and the second highest bidder (reserve bidder) shall be invited to complete the transaction.
(3.13) If the reserve bidder fails to comply with the terms of sale, the deposit
shall also be forfeited and paragraph 3.5 3.8 shall apply thereafter.
(4.0) Bid Format

(5.0) Submission and Opening of Bids
(5.1) Completed bid shall be submitted in sealed envelope and labelled “landed property at No. 3 Milverton Road, Ikoyi, Lagos” at the top right corner, and submitted not later 12:00 noon on Tuesday, 5th May, 2015 at the Office of:

(5.2) The closing date for the submission of bid is on or before 12:00 noon, May 5th 2015.
(5.3) Bids will be opened at 12:00 noon on May 5, 2015 in the presence of bidders or their representatives who wish to witness the opening at:
