1. Introduction
The Nigerian Shippers’ Council, a parastatal under the Federal Ministry of Transport, In line with the Public Procurement Act of 2007, the Infrastructural Concession Regulatory Commission (ICRC) Act 2005 and National Policy on Public Private Partnership (PR) hereby invite proposals for the Selection of Concessionaire for the development of Inland Container Depot in Lolo, Kebbi State, Nigeria under Public Private Partnership (PPP).
In this connection FGN is desirous to assess the strategic fit, value for money and affordability for the concession of the Lolo ICD to finance, construct, maintain and operate the scheme.
- Background.
COMPETITIVE
Nigerian Shippers’ Council (NSC) has received a proposal from a Proponent for the development of Inland Container Depot (ICD) in Lolo, Kebbi State under a Private Partnership (PPP) Scheme. The proposal has been reviewed by ICRC and is classified as an unsolicited proposal which allows unique competitive and innovative ideas or approaches for service delivery that has been developed outside the Government to be made available to Ministries, Department, and Agencies (MDAs) for use in the accomplishment of Government’s transformational goals.
The Procurement of all concessions is required to adhere to the national policy on Public Private Partnership published by the Infrastructure Concession Regulatory Commission (ICRC). The ICRC Act, in line with PPA, 2007 makes it mandatory for all PPP projects to go through competitive bidding process in order to achieve value for money, ensure fairness and transparent bidding process.
Therefore, in recognition of the initial investment of the project proponent, the ICRC recommended that a Swiss Challenge bidding process be carried out to select a concessionaire for the project. The Swiss Challenge bidding process involves inviting other qualified potential proponents to competitively bid for the project. If the original project proponent’s bid does not remain the most responsive, it will be given the right to match the most responsive bid from other potential proponents to win the concession. However, if the original project proponent is unable to match the most responsive bid, then the firm with the most responsive bid wins the Swiss challenge
NSC, through this advert hereby invites qualified prospective Concessionaire to submit Technical and Financial proposals for-the concessioning of Inland Container Depot project for Lolo, Kebbi State.
3. Terms of Reference
The prospective concessionaire would produce the technical proposal detailing the following
- Business Plan/Outline Business Case (OBC)
- Technical scope – description of the key technical parameters envisioned for the project.
- Needs analysis – high level review of project’s commercial rational, analysis of the demand for the proposed services and the desirability of the project.
- Cost Estimation- preliminary project costing, public sector comparator development.
- Procurement and construction plan.
- Preliminary assessment of social and environmental impacts of the projects;
- Affordability analysis;
- Risk analysts;
- Operation and Maintenance;
- Cost estimates, tariff Nurture, financial forecast and financial plan; and
- Financial model.
- General Eligibility Criteria.
Only prospective concessionaires that have proven capability, relevant experience and good track of records will be shortlisted. Those interested must submit the following:
- Profile of firm (including evidence of business registration/ Certificate of Incorporation with Corporate Affairs Commission, relevant professional registrations, satisfactory evidence of association, capability profile of the firm and contact details,
- Certified true copy of particulars of directors (ownership structure)
- Photocopies of Tax clearance Certificate for three (3) years: 2011, 2012 and 2013.
- Evidence of VAT Registration and remittance of Value Added Tax. VAT, With-holding tax (WHT) and Pay As You Earn (PAYE)
- Evidence of compliance and remittance with the provisions of the Pension Reform Act 2004.
- Evidence of remittance to Industrial Training Fund (TTF).
- Evidence of detailed previous experience for similar commitments ( e.g engagement letter)
- Evidence of Financial Capability from the bank.
- Copies of abridged audited financial reports for the last three years: 2011, 2012 and 2013.
- Collection of Bidding Documents.

on payment of a non refundable bid processing fee of N10,000.00 through bank draft payable to Nigerian Shippers’ Council, Lagos.
- Method of Submission
The Technical Proposal marked “TP” and Financial Proposal marked “FP” (1 original each and 3 copies each) sealed with Company’s name and lot numbers in separate envelopes which in turn should be sealed in a larger envelope along with soft copy version, to be slotted into “REQUEST FOR PROPOSAL (ICD LOLO, KEBBI STATE)” Box on the 11th floor after its registration with Procurement Unit on the 7th floor.

- Important Notice:
- All proposals must be received not later than 4pm on Tuesday, 8th July, 2014
ii. Only firms whose Technical Proposals fulfill the minimum requirements would be invited for financial Proposals Opening exercise.
- This notice shall not be construed to be a commitment on the part of Nigerian Shippers’ Council to award any form of contract to any respondent(s) nor shall it entitle any organization submitting document to claim any indemnity from the Council.
