Invitation for Technical and Financial Bids from Interested Bidders for Projects under the 2014 Appropriation Act
1.0 Introduction
1.1 The Benin-Owena River Basin Development Authority (hereinafter referred to as “the Authority”), a Parastatal of the Federal Ministry of Water Resources, is desirous of executing various water related projects. In compliance with the Public Procurement Act, the Authority hereby invites interested Contractors to submit Technical and Financial Bids for the implementation of her Capital Projects in the 2014 Appropriation as follows:-

2.0 Eligibility Criteria:
Competent and interested Companies who hold the requisite experience, equipment and plants, who desire to execute any of the projects are required to submit their Firms’ Profiles (serially as itemized below, paged and with table of contents) which must include but not limited to the following documents.
FOR CONSULTANCY SERVICES
a) Evidence of registration with Corporate Affairs Commission (C AC) by inclusion of and Articles of Association;
b) Last three (3) years Tax Clearance Certificates (2011, 2012 & 2013);
c) Detailed Company Profile – For authentication purpose, photocopies of professional certificates of personnel must be signed and sealed by the owners;
d) Evidence of experience in at least five (5) jobs of similar nature and complexity executed within the last five (5) years with verifiable letters of contract award and certificates of job completion;
e) Evidence of financial capability vide a Reference Letter from an acceptable reputable bank;
f) A copy of Memorandum of Understanding (MOU) in case of Bidders in Joint Ventures (JV);
g) Evidence of Personnel Capability including list of key Professionals, Curriculum Vitae of each professional and registration with professional bodies such as ARCON or COREN, COMEG or ICAN, etc;
h) Full accounts details including SORT code;
i) Evidence of Pension compliance Certificate from National Pension Commission;
j) Acceptable Quality Assurance/Quality Control Manual;
k) VAT Registration with Evidence of Remittances for the last three(3) years (2011, 2012 & 2013).
l) Three (3) Years Audited Accounts (2011, 2012 & 2013) signed and sealed by a Licensed Registered Accountant
m) Evidence of Pension Compliance Certificate from National Pension Commission and
n) Evidence of Industrial Training Fund (I.T.F) Clearance Certificate.
NOTE:
Consultants are to pay a non-refundable fee of N10, 000.00 each being cost of produce of documents on LOTS A1-A3 into the same bank account.
2.2 FOR WORKS
a) Evidence of registration with Corporate Affairs Commission (CAC) by inclusion of Certificate of Incorporation and Articles of Association;
b) Last three (3) years Tax Clearance Certificate (2011, 2012 & 2013) with the company’s Tax Identification Number (TIN),
c) Value Added Tax (VAT) Registration and Remittance (2011, 2012 & 2013)
d) Detailed Company Profile – For authentication purpose, photocopies of professional certificates of personnel must be signed and sealed by the owner;
e) Evidence of ownership of/or access to lease of relevant construction equipment and their status (where applicable)
f) Evidence of experience as a Contractor in at least five (5) projects of similar nature and complexity with verifiable letters of contract award and certificates of job completion (if already completed) within the last five (5) years (works cited should be at least 70% physically completed);
g) Evidence of liquidity or access to credit facilities of not less than N50,000,000.00 (Fifty Million Naira) from an acceptable and reputable Bank;
h) A copy of Memorandum of Understanding (MOU) in case of Bidders in Joint Ventures (TV)
i) Full accounts details including SORT code;
j) Evidence of Pension compliance Certificate from National Pension Commission;
k) Evidence of Industrial Training Fund (I.T.F) Clearance Certificate;
l) Acceptable Quality Assurance/Quality Control Manual;
m) Three (3) Years Audited Accounts (2011, 2012 & 2013) signed and sealed by a Licensed Auditor and
n) This Audited Account must have a turnover of the same value as in the Tax Clearance Certificate.
FOR GOODS:
a) Evidence of registration with Corporate Affairs Commission (CAC) by inclusion of Certificate of Incorporation and Articles of Association;
b) Last three (3) years Tax Clearance Certificate (2011, 2012 & 2013) with the Company’s Tax Identification Number (TIN);

d) Detailed Company Profile – For authentication purpose, photocopies of professional certificates of personnel must be signed and sealed by the owner;
e) A copy of Memorandum of Understanding (MOU) in case of Bidders in Joint Ventures (JV);
f) Full accounts details including SORT code;
g) Evidence of Pension compliance Certificate from National Pension Commission;
h) Evidence of Industrial Training Fund (I.T.F) Clearance Certificate;
i) Evidence of Experience in at three (3) Supplied Jobs executed within the last 5 years with veritable letters of contract award and certificates of job completion and
j) Evidence of Financial Capability/Bank Reference Letter from acceptable reputable bank.
2.4All Bidders are requested to also provide Current Sworn Affidavits certifying as follows:-
i) That the Company is not in receivership, not Insolvent or Bankrupt.
ii) That the Company does not have any Director who has been convicted in any Court in Nigeria or any other Country for Criminal Offence in relation to fraud or financial impropriety.
iii) That no officer of the Authority is a former or present Director or Shareholder of the Company.
iv) That there has been no promise of a gift in any form to any staff of the Authority, or Bureau of Public Procurement (BPP).
2.5 Bid Security:
For Financial Bids in the value of Ten Million Naira (N10,000,000.00) and above, the Bid should be accompanied with Standard Bid Security or Bank Draft which should be 2% of the Tender Sum.
3.0 Collection of Tender Documents
3.1 Interested Contractors shall on application collect Bid Documents between 9.00a.m and 3.00p.m., beginning from Monday, 30th June, 2014 from:

4.0 Submission of Bids
4.1 Completed Technical and Financial Bids shall be submitted in Two hard copies and One Electronic copy (non-refundable compact disk/DVD) in two different sealed envelopes and labeled “Technical and “Financial Bid” respectively with “Project category and Lot Number” at the top right corner and enclosed in a Third envelop on which is also indicated the Project category and Lot Number at top right corner and addressed to:

And submitted in the New Conference Room (into a secured tamper proof bid-box) at the Headquarters Complex Benin Owena River Basin Development Authority, Km 24, Benin/Sapele Road, Obayantor.
NOTE that only the two (2) inner envelopes should carry the bidder’s name.
4.2 All bids must be signed by an authorized signatory of the bidders). Any unsigned bids will be disqualified. The signature on the summary’ page of the financial bid must be directly below the quoted tender sum.
4.3 The closing date for the submission of respective bids are on or before 12.00noon on Wednesday, 30th July, 2014:
4.4 Only firms whose technical bids fulfill the minimum requirements would have their financial bids considered for the next stage. .
4.5 All documents submitted by bidders may be subjected to due diligence checks in accordance with the Public Procurement Act 2007.
4.6 For Contractors bidding for more than one lot, each lot must be packaged and submitted separately.

Note:
Interested Contractors are advised to avail themselves of the Public Procurement Act (PPA) 2007 and are invited to a pre-tendering meeting with the Authority at the Headquarters Complex, km.24, Benin/Sapele Road, Obayantor on Friday, 4th July, 2014 OR the Area Office Complex, Alagbaka GRA, Akure on MONDAY, 7th July, 2014 at 11 .00am each day. Inability to attend the meeting does not however prevent interested Contractors from bidding.
5.0 Disclaimer and Conclusion
5.1 This invitation is published for information purposes and does not constitute a commitment or obligation on the part of the Authority to enter into a contract
5.2 The Authority shall not be responsible for any costs or expenses incurred by any interested party(ies) in connection with any response to this invitation and or the preparation or submission in response to an inquiry.
5 3 The Authority is not bound to shortlist any bidder and reserves the right to annul the selection process at any time without incurring any liabilities and assigning any reason thereof.
