1.0 Introduction
In line with the provisions of the Public Procurement Act, 2007 the Rural Electrification Agency hereby invites interested, competent and experienced contractors to submit tenders for the 3rd batch of Constituency/Zonal Intervention Rural Electrification Projects it intends to procure under the 2014 FGN Capital Appropriation as detailed below:

3.0 Eligibility Criteria
Prospective bidders are required to submit the following documents in proof of their Technical eligibility:
i. Certificate of Incorporation with Corporate Affairs Commission (CAC) with copies of Forms C02 and CO7.
ii. Three (3) years Tax Clearance Certificate (2011, 2012 and 2013) expiring December, 2014.
iii. Evidence of remittance of VAT to FIRS for the last 3 years. Certificate of compliance with the Pension Reform Act 2004 issued by the Pension Commission (PENCOM).
iv. Evidence of payment of Training Contributions to ITF in compliance with Section 6(2) of the Industrial Training Fund Amended Act 2011.
v. Certificate of compliance with the Employee’s Compensation Act/evidence of remittances to the Nigerian Social Insurance Trust Fund (NSITF).
vi. Verifiable evidence of contracts of similar nature and complexity executed in the last 10 years, (Letters of Award with Interim, completion or payment certificates required).
vii. Evidence of financial capability to execute the contract (attach Bank reference and last 6 months Company’s Bank Statement of Accounts).
viii. List of available equipment for execution of rural electrification project, indicating whether you own or lease them. (please attach proof of ownership or lease).
ix. Authorization for a specific person to act as a representative of the company for purposes of signing bids, contract agreement and other documents with REA. (Properly executed Power of Attorney or Board Resolution required)
x. A sworn Affidavit disclosing whether or not:
(a) Any officer of the Rural Electrification Agency (REA) or Bureau of Public Procurement (BPP) is a former or present director, shareholder or has any pecuniary interest in the company.
(b) The company is presently in receivership, or subject of any form of insolvency or bankruptcy or winding up petition or proceedings.
(c) Any Director of the company has ever been convicted in any country of any criminal offence, fraud or financial impropriety
xi. A letter authorizing the Rural Electrification Agency to verify the authenticity of claims and documents submitted by the company with relevant authorities.
xii. A clean copy of the certified Payment Receipt for the Non-refundable Tender fee of N25,000 to the Agency.
xiii. Possession of Certificate of registration under the BPP’s National Data Base for Federal contractors shall be an advantage
4.0 Collection of Tender Documents
4.2 Interested Bidders are to pay a non-refundable Tender fee of N25,000.00
(Twenty Five Thousand Naira) only in Bank Draft drawn in favour of the Rural Electrification Agency to the Cash Office in the Funds Directorate at Agency’s Corporate Headquarters, 22 Free Town Street, Wuse 2, Abuja and obtain a receipt.
4.3 Original and Photostat copies of the receipt should then be presented to Procurement Directorate in the same building for collection of Tender Documents between the hours of 10:00am and 4:00pm Mondays to Fridays on or before 12:00 noon, Monday 20th October, 2014.
4.4 Please note that the original copy of the payment receipt must be sighted and certified by the Procurement Desk officer before issuance of Tender Documents
5.0 Submission and Opening of Tender Documents
5.1 Three (3) spirally bound hard copies i.e one ORIGINAL and two duplicate copies of the Technical Document and Three (3) hard copies of the Financial Bid i.e one ORIGINAL and two duplicate copies also neatly bound in A4 size papers must be submitted together with One CD soft copy containing the Financial Bid done in Excel and marked on the printable surface with the company‘s name and the selected project lot number.
5.2 The Tenderer shall enclose the original copies of the “Technical” and “Financial Documents in one (1) envelope and the Duplicate copies in another envelope, duly marking the envelopes as “ORIGINAL” and “COPY.” These two (2) envelopes shall then be enclosed m one (1) single bigger outer envelope with the LOT NUMBER, Project Title and Package Number clearly indicated on the top left corner and addressed to:

5.3 The reverse side of all envelopes used must bear the contractor’s name and address (in capital letters) and the authorized contact person’s phone numbers.
5.4 All Tenders are to be dropped in the tamper proof “Tender Boxes” in the Reception area i.e. (Ground Floor) of the Agency’s Corporate Headquarters, 22 Free Town Street, Wuse 2, Abuja not later than 12:00 Noon on Monday, 20th October, 2014. Bids submitted after this deadline shall be rejected.
5.5 Opening of Tenders shall commence immediately after the submission deadline i.e. by 12:00 Noon on Monday, 20the October, 2014 in the premises of the Agency’s Corporate Headquarters.
6.0 Important Notices
6.1 Each eligible company is allowed to bid for only ONE LOT. Multiple lot bidding is not permitted and any company discovered to have submitted bids for more than one lot shall be disqualified or excluded from this procurement process.
6.2 Companies that are related or found to have the same directors or personnel shall be consolidated and treated as one company for purposes of enforcing the policy of one eligible company to one contract 6,3 Failure to use or adhere strictly to the REA Standard Bidding Documents as issued will result in disqualification. It is mandatory to complete all the relevant sections including the forms in Section 5 of the Standard Bidding Document.
6.4 No Bid Security is required and the Agency shall not be responsible for loss of unsolicited bid security enclosed in any Tender.
6.5 Contractors with history of abandonment/non-completion of rural electrification contracts or who lack capacity need not apply.
6.6 Tenders in envelopes not correctly addressed or that omit the Lot Number, Project title, Package number or contractor’s identification on the reverse side shall be rejected.
6.7 All documents submitted shall be referred to either security agencies or the issuing authorities for verification.
6.8 The Agency shall not be liable to any bidder tor loss or refusal to accept any loose papers stapled or inserted in-between bound documents or for submissions not bound
7.0 Disclaimer And Conclusion
7.1 This advertisement is published for information purposes only and does not constitute an offer, commitment or obligation by REA to transact with any party, nor entitle any Contractor to make any claims whatsoever/or seek any indemnity from the Agency.
7.2 The Agency will not be responsible for any costs or expenses incurred by any interested party in connection with preparation of documents or submissions made in response to this invitation and or in response to any inquiry or clarification arising there from.
7.3 The Rural Electrification Agency pledges fair and equal treatment of all bidders but is not bound to shortlist any bidder and reserves the right to annul the selection process at any time without incurring any liabilities to the bidders.
