Expression of Interest (Lawyers and Notaries)
The ECOWAS Bank for Investment and Development (EBID) is the financial institution established by the 15 Member States of the Economic Community of West African States (ECOWAS) comprising Benin, Burkina Faso, Cape Verde, Cote d’ivoire, The Gambia, Ghana, Guinea, Guinea-Bissau, Liberia, Mali, Niger, Nigeria, Senegal, Sierra Leone and Togo.
EBID is inviting applications from suitably qualified legal practioners and other Notaries) to offer legal advisory services and support to the Bank.
Selected applicants will among others, provide the following services to the Bank: Defend the interest of EBID in any administrative or judicial proceedings the Bank initiates or over which it requires defence.
Draft, register and archive securities and loan guarantees granted by the Bank.
Provide legal advice and legal research on specific issues of relevance to the Bank; and
Assist in drafting loan agreements between the Bank and borrowers in their respective countries.

(ii) Procedures for Submission of Dossier
All interested applicants are advised to submit:
(a) A statement of expression of interest signed by the Representative of the firm or company indicating his name, position, address, home country.
(b) Introduction of the firm or company (date of establishment, headquarters, company name, legal entity type, address and phone number etc.) and human and material resources that the company intends to deploy in the implementing the assignment (list of key staff and their respective duties career path, length of time in service and type of contract with staff of the firm or company), areas of competence.
(c) A certificate of membership of the professional body that the service provider belongs and proof that the candidate has not been under any sanction or disciplinary procedure in the past five years.
(d) Tax clearance certificate (direct and indirect taxation) of not less than 3 months validity.
(e) Evidence of social security contributions (pensions schemes contributions) of not less than 3 months.
(f) Any document justifying the candidates financial capacity and solvency in the past three (3) years (annual reports, tax returns on professional income, etc.).
(g) Professional references of the firm or company.
iii. Criteria for Selection
Candidates must show proof of:
- Expertise in the area and sound knowledge of the constraints concerning the activities of an investment and development bank.
- Ability and considerable willingness to provide the Services expected and show considerable proof of proactive approach in treating dossiers assigned
- Sound knowledge of local and community law (OHADA) for candidates applying from French Speaking Member States: knowledge of local and other
- Community Laws in the case of candidates applying from Member States that are not under the jurisdiction of OHADA law
- Qualified staff, capable of providing required services satisfactory.
(iv) Submission of Dossiers
All documents submitted in paper form must reach the Bank not later than 29th December 2014 in a sealed envelope at 5p.m which should bear “Expression of
Interest to Select A Law Firm … (Lawyers or Notaries) in three (3) copies written in English or French and addressed to:

NB:
(i) This notice does not constitute any sort of offer from EDID to deal with any party whatsoever. Neither does it imply any obligation from EBID.
(ii) EBID shall not be held liable for any cost or expenses incurred by a firm within the framework of this notice.
(iii) Only shortlisted law firms shall be contacted.
(iv) EBID shall reserve the right not to continue with this notice of Expression of Interest.
