1.0 Introduction:
The Nigerian National Petroleum Corporation (NNPC) intends to undertake the construction of 324,000 litres capacity Braithwaite water storage tank for the on-going fire hydrant upgrade project at NNPC Towers, Abuja. The construction of 324,000 litres capacity Braithwaite Water Storage Tank will support the on-going Fire Hydrant Upgrade Project, a project initiated to upgrade the Fire Hydrant Water Pressure at NNPC Towers, Abuja
By this publication, competent and reputable Contractors/Companies are invited to submit Expression of Interest for the required tank construction works including the associated mechanical, piping system, electrical, civil/structural, instrumentation and control works and other necessary works for complete execution of this project.
Only pre-qualified Companies will be invited to submit technical and commercial tenders for the works.
2.0 Description of the Project Scope:
The scope of works to be undertaken by the tank construction company shall include, but not limited to the following:
2.1 Erection of one 324,000 litres capacity Braithwaite water storage tank including the associated Mechanical works
2.2 Piping system including valves, fittings, etc
2.3 Electrical works
2.4 Instrumentation and Control works including tank gauge, level indicator, etc.
2.5 Civil works/Structural works including tank foundation, access stairways and support.
2.6 Other works as may be so stated in the scope
All works to be carried out in accordance with contract drawings and specification.
3.0 Submission of Expression of Interest:
All companies wishing to express interest to bid for this tank erection project shall submit relevant documentation for prequalification as stipulated in 5.0 below.
Only companies that are adjudged successful shall be invited to collect Tender Documents for the works and services involved in the construction of 324,000 litres capacity Braithwaite water storage tank for the on-going fire hydrant upgrade project at NNPC Towers, Abuja as described in 2.0 above.
4.0 Contract Strategy:
The Contract Strategy for the construction of 324,000 litres capacity Braithwaite water storage tank for the on-going fire hydrant upgrade project at NNPC Towers, Abuja shall be awarded to the most competitive and responsive bidder.
Following this advertisement, the selection process will progress as follows; – Pre-qualification -Technical Bidding – Commercial Bidding -Contract Award.
Successfully prequalified companies would be subjected to technical evaluation which is in line with NNPC applicable procedure and Nigerian law requirement.
5.0 Prequalification Requirements:
By this publication, NNPC in compliance with the provisions of the Public Procurement Act 2007 and the Bureau for Public Procurement guidelines, request interested and competent tank construction companies to submit the details listed hereunder in their prequalification bid documents.
5.1 Full details of company profile complete with CAC Certificate of Incorporation in Nigeria, Certified true copies of Memorandum and Articles of Association of the Company and CAC Forms C 02 and C 07 (Particulars of Directors).
5.2 Certified true copies of Company Tax Clearance Certificates for the last three (3) years (2012, 2013, & 2014).
5.3 Evidence of VAT Registration and Remittance
5.4 Evidence of compliance with Part iv, Section 16(6d) of the Public Procurement Act
5.5 Proof of Company’s financial capabilities, including audited accounts for the last three (3) years along with corresponding tax clearance certificates, Value-Added Tax (VAT) registration certificate and evidence of past VAT remittances.
5.6 Evidence of compliance with the provisions of Section 6 (1) (3) of the amended Industrial Training Fund (ITF) Act No.19 of 2011.
5.7 Evidence of COREN Practicing Licence.
5.8 Audited Accounts for the past three years (2011, 2012, 20113)
5.9 Nigerian Content Plan that demonstrates the full utilization of Nigerian Labour and services with detailed description of role, work scope, and man-hours in order to achieve the minimum target as set out in the requirements of the NOGICD Act 2010.
5.10 Current and in-place organizational structure with detailed experience and skills of key management personnel with names. Provide evidence (personnel lists and positions with organizational chart to substantiate) of percentage of management that are Nigerians.
5.11 Detailed past commitment to staff training and development of Nigerian personnel.
5.12 Where the bidding entity lacks total capacity, genuine alliance with other company for the purpose of technology transfer shall be encouraged. The alliance/joint venture shall be executed with a Memorandum of Agreement (MoA) signed by the chief executives of both entities and duly certified by a court of competent jurisdiction or Notary Public. The MoA shall state clear work-ratio between the parties and time frame for growth or transfer to be achieved.
5.13 Evidence of Financial Capabilities/Bank Reference.
5.14 Evidence of relevant verifiable work experience on similar projects in Nigeria over the last five (5) years. (Please attach job completion certificates for completed projects and status report for on-going projects including year, project tittle, client, project value, and duration, client’s contact person, phone numbers, and e-mail address, etc.)
5.15 Company full contact address (not P.O. Box), functional phone numbers and e-mail address.
5.16 Evidence of Pension Compliance Certificate or Exemption from PENCOM.
5.17 Organizational structure and available work force with CV’s of key personnel showing evidence, of adequate human capital for the required services.
5.18 Relevant and verifiable cognate experience with NNPC, or other organizations, on similar projects in the past five (5) years. (Please attach job completion certificates for completed projects and contract award letter(s) and latest status report for on-going | project(s) including year, project title, client, project value and duration, client’s contact person, phone number and e-mail address, etc.)
5.19 Provide, with verifiable evidence, list of relevant equipment owned, leased and/or to be sourced by the company as required by this project.
5.20 Confirm willingness to commence with the execution of this project on the basis of a Letter of Intent (LOI).
5.21 Company’s obligation to pay taxes, pensions and social security contributions in line with Section 16 (6) d of the Public Procurement Act (PPA) 2007 and Section 1 (2) of the Pension Reform Act including tax clearance certificates for the past three years.
5.22 Company’s CASHES and QA/QC policy: Demonstrable ability and verifiable evidence to handle topical community issues; Details of safety records for accidents, injuries and damages for the past three (3) years – e.g. Lost Time Incidents, Down-time, etc.
5.23 Any additional information that will enhance the potentials of the Company.
Only Contractors/companies that fulfil the above requirements and also pass the pre-qualification evaluation exercise shall be invited to submit technical and commercial bids for the job.
6.0 Nigerian Content Development:
Pursuant to NNPC and Federal Government Policy to provide opportunities for Nigerian contractors and the development of local expertise, all the applicants must comply fully with the NOGICD Act to give preference to Nigerian companies or foreign companies with Nigerian affiliate and local ownership, which demonstrate willingness to execute the project to the satisfaction of the Nigerian Content requirements and guidelines. Each applicant is enjoined to avail themselves of the requirements of the Nigerian Oil and Gas Industry Content Development (NOGICD) Act for full compliance.
Nigerian National Petroleum Corporation (NNPC) is committed to fully comply with the requirements of the NOGICD Act. In maximizing the local content of this project, pre-qualifiers are requested to give full details of their strategy for the local content implementation in order to comply fully with the law.
Specifically the Contractor shall;
6.1 Ensure that 50% of the equipment deployed for execution of the work is owned by a Nigerian Company or Nigerian Subsidiary with clear and documented evidence of ownership.
6.2 Provide full details of company profile and ownership, “Form C02” and “Form C07” of the Corporate Affairs Commission.
6.3 Provide Evidence of registration into the NOGICD Joint Qualification System (NOGICJQS).
6.4 Provide detailed Company Organogram, list of proposed workforce and CVs of all staff from intermediate level and above.
6.5 Provide evidence that the company is COREN registered.
6.6 Provide statement of the name and location of the Nigerian Bank and any other financial institution engaged (this should also include the responsibility and scope of engagement with the Nigerian financial institution).
6.7 Provide verifiable information on name and location of Nigerian Legal service providers.
6.8 Provide verifiable information on name and location of Nigerian Insurance service providers.
6.9 Furnish company NC policy/strategy.
6.10 Demonstrate awareness of legislative & regulatory provisions as it concerns Nigerian content.
6.11 Provide details of Company’s Nigerian Content manager (if any) with appropriate experience, qualifications, clear responsibilities & targets.
6.12 Make commitment to transfer technology, employment, generation and competence development.
6.13 Provide evidence of an understanding of the local business environment & existing relationships with Nigerian enterprises & suppliers.
6.14 Provide evidence of success in nurturing Nigerian Content on previous projects.
6.15 Make available existing initiatives to develop Nigerian affiliates (For companies not resident in Nigeria).
6.16 Provide evidence of an existing/established presence in Nigeria or plans to establish a presence.
6.17 Provide location(s) of Project Management team and Procurement centre for the subject project
6.18 Identify Nigerian scope of work as a percentage of the total work scope.
6.19 Provide project specific Human capacity development training execution plans for Nigerians.
Submission of Pre-Qualification Package:
The requested information and any supporting documents in respect of these requirements should be submitted in one original plus three duplicate hard copies and two electronic copies (CD ROM). 7.0 Important Information:
It must be noted that:
7.1 The submissions will be opened immediately following the deadline stipulated for the submission of bids or any extension thereof.
7.2 Your company shall provide NNPC with a letter of Authority to verify all claims made in your submissions.
7.3 For Joint Ventures or Partnerships, the previous experience being claimed may include those executed by the Joint Venture or Partnership where applicable, as well as the individual relevant experiences, provided the Joint Venture or Partnership Agreement/Memorandum plus the Power of Attorney linking the companies is submitted.
7.4 Please note that this is not an Invitation to Tender. Only Companies adjudged qualified by NNPC under this prequalification procedure shall be invited to participate in the competitive tender.
7.5 NNPC reserves the absolute discretion and right to either accept or reject any documents and it shall not be required to assign a reason for refusal to invite your company to participate in the bidding exercise or to enter into any correspondence concerning the selection of any contractor for the services.
7.6 All costs incurred by your company as a result of this prequalification exercise and any subsequent request for information shall be to your account.
